The terms on which R.A.J Digital Agency supplies websites, branded business apps, ongoing management and NFC review products.

About these terms
These terms apply to all products and services supplied by R.A.J Digital Agency, a UK sole trader trading at rajdigitalagency.co.uk. By placing an order, paying a setup fee or continuing to use a service we provide, you accept these terms.
Where we have agreed a written quote, proposal or package description with you, that scope applies alongside these terms. If there is a conflict, the agreed scope takes precedence for the work it covers.
Our services
Depending on the package purchased and the scope agreed, we may supply: a professionally designed and managed business website; a branded customer web app or installable app (PWA); online ordering and/or booking functionality; a business dashboard; loyalty functionality; promotions and marketing tools; AI-assisted marketing features; QR codes and marketing materials; ongoing management, maintenance and support; and programmed NFC Google Review Cards and NFC Review Stands.
Not every feature is included in every package. What you receive depends on the package you purchase and the scope we agree with you. Features described on our website are illustrative of what we can provide, not a guarantee that all of them are included in your plan.
Setup fees and recurring payments
Website and app packages are charged as a one-off setup fee plus a rolling monthly management and support fee:
Essential Package — £199 one-off setup fee and £19 per month. Monthly billing begins after the initial 7-day setup period.
Business Package — £299 one-off setup fee and £29 per month. Monthly billing begins after the initial 14-day setup period.
Growth Package — £499 one-off setup fee and £59 per month. Monthly billing begins after the initial 14-day setup period.
The setup fee covers the design, build, configuration and testing work needed to prepare your services. The initial setup period is the time allowed for that work — it is not a free trial and the setup fee is payable in respect of the work carried out.
Monthly fees continue on a rolling basis until cancelled in line with the cancellation section below. All prices are in pounds sterling.
Setup and delivery
The initial setup periods above are targets for preparing your services and depend on us receiving what we need from you.
We are not responsible for delays caused by information, branding, menus, service lists, images, approvals or access credentials being supplied late or incompletely, or by the availability of third-party services outside our reasonable control. Where a delay of that kind occurs, monthly billing may still begin at the end of the initial setup period.
Your responsibilities
You are responsible for making sure the information you give us is accurate and up to date, and that you have the rights and permissions needed to use any logos, photographs, menus, text, trademarks or other material you supply to us.
You remain responsible for the accuracy of your own prices, menus, opening hours, services, promotions, allergen or product information and other commercial content, even where we help you enter or manage it.
You must keep account credentials secure and must not use our services for unlawful purposes or in a way that breaches the terms of any third-party platform we integrate with.
AI-assisted content
Some features use AI to help produce marketing copy and images, write notification or leaflet wording, or read an uploaded menu and convert it into menu items. AI output is a starting point and should be checked before it is published or used. We cannot guarantee that AI-generated or AI-extracted material will always be accurate, complete or suitable, and you are responsible for reviewing and approving anything published on your website or app.
Ongoing management and support
Your monthly fee covers hosting and maintenance of the managed service, security and backups where applicable, support, and reasonable minor updates such as text changes, opening hours, prices, images and occasional additional products or services.
Larger work is outside the monthly fee — for example a full menu or catalogue rebuild, substantial new sections or pages, a major redesign, significant content replacement, or additional functionality. We will quote for that work separately and any additional charge will be agreed with you before it is carried out.
Third-party services
Our services depend on third-party platforms including hosting and database infrastructure, payment processors, domain and DNS providers, AI providers, and email or messaging providers. We choose providers we consider reliable, but we do not control them and cannot guarantee uninterrupted or error-free availability of systems outside our reasonable control. Your use of those services may also be subject to their own terms.
Payments
Payments are processed securely by third-party payment providers such as Stripe. Card details are entered with the payment provider and we do not store full payment card details ourselves. Recurring monthly fees are taken using the payment method you have registered. Unless stated otherwise, prices exclude any delivery charges, which are shown before you complete an order.
Failed or late payments
If a recurring payment fails or an invoice remains unpaid, we will contact you to arrange payment and allow a reasonable opportunity to resolve it. If payment is still outstanding after reasonable notice, we may suspend managed services, dashboards or app access until the account is brought up to date. We will not delete your content simply because a payment has failed; deletion is dealt with under the cancellation section below.
Cancellation
You can cancel a recurring management plan at any time by emailing hello@rajdigitalagency.co.uk. Please give 30 days' notice. Your service continues, and remains payable, until the end of the notice period, and we do not refund monthly fees for a period already paid unless we have failed to provide the service.
After cancellation takes effect, hosted and managed functionality — including the managed website, branded app, ordering, booking, loyalty and dashboard features — will stop being provided. We will keep your data for a reasonable period after cancellation so that a copy or export can be requested, after which it may be deleted.
Domain names and third-party accounts registered in your name remain yours. Where we hold a domain or third-party account on your behalf, we will cooperate reasonably with a transfer to you or your new provider once any outstanding amounts have been paid. Nothing in these terms transfers ownership of your domain or third-party assets to us unless we have specifically agreed that in writing.
We may end a service by giving you 30 days' notice, or sooner where there is a serious or repeated breach of these terms.
Ownership and licensing
You keep ownership of the material you supply — your business name, logo, photographs, menus, product and service information, and other content — and you grant us the licence needed to use it for the purpose of providing your services.
We keep ownership of our reusable platform, software, app-builder technology, templates, components, designs, systems and underlying code, including anything we develop while providing services to you, unless we have expressly agreed otherwise in writing.
While your service is active and paid for, you have a non-exclusive right to use the managed website and app we provide for your business, subject to these terms. That right ends when the service ends.
NFC Review Cards and Stands
NFC Review Cards and Review Stands are programmed using the Google Business Profile or review URL you supply. You are responsible for providing the correct destination link and for telling us if it changes.
Our products make it easier for a customer to reach your review page. We do not filter, gate, screen or incentivise reviews, and the rating and wording of any review are entirely up to the customer.
We cannot guarantee any number of reviews, ratings, search rankings, customer behaviour or revenue. NFC functionality depends on the customer's device supporting and enabling NFC.
Limitation of liability
Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence or for fraud.
We do not make guarantees about sales, revenue, review numbers, search rankings, customer numbers, uninterrupted uptime or business performance.
Subject to the above, we are not liable for loss of profit, loss of business, loss of anticipated savings, loss of goodwill, or indirect or consequential loss. Our total liability arising out of or in connection with the services in any 12-month period is limited to the total fees you paid us for the relevant service in the 12 months before the claim arose.
Where you buy as a consumer rather than for business purposes, your statutory rights are not affected by this section.
Changes to services and terms
We may update our services and these terms from time to time, for example to reflect new features, provider changes or legal requirements. The current version is always published on this page. Where a change materially affects an existing customer, we will tell you in advance where it is appropriate to do so; continuing to use the service after that point means the updated terms apply.
Governing law
These terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory rights or protections that apply to you.
